Terms of Service

Please read these Terms of Service ("Terms") carefully before using Passpartoo ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using Passpartoo, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

2. Description of the Service

Passpartoo is a personal ticket-organization app. It allows you to manually enter, import, and store information about your event tickets (such as titles, dates, venues, seat details, QR/barcodes, and original ticket documents) for your own personal, non-commercial use. All data is stored locally on your device.

Passpartoo is an organizational tool only. It is not a ticketing platform, ticket seller, ticket issuer, or ticket marketplace, and it has no affiliation with any event organizer, venue, or ticket vendor whose tickets you may store in the App.

3. Eligibility

You must be able to form a legally binding contract to use the App. If you are under the age of majority in your jurisdiction, you should only use the App with the involvement of a parent or guardian. See our Privacy Policy for our children's-privacy approach.

4. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your own personal, non-commercial use.

You agree not to:

• Copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the App, except to the extent applicable law expressly permits this despite this restriction.
• Use the App for any unlawful purpose, including storing or facilitating the use of fraudulent, stolen, or counterfeit tickets.
• Attempt to interfere with, disrupt, or gain unauthorized access to any part of the App or its systems.
• Use the App to violate the terms of service of any third-party ticket issuer or venue.

5. Your Responsibility for Your Tickets

This is important: Passpartoo helps you organize and view information about tickets you already own. It does not guarantee, verify, or vouch for the validity, authenticity, or continued acceptance of any ticket you store in it.

• You are solely responsible for the accuracy of information you enter or import into the App.
• You are solely responsible for backing up important tickets through official channels (e.g., the original issuer's app, email, or PDF) and should not rely on Passpartoo as your sole copy of a ticket, especially for events you cannot afford to miss.
• Where possible, we recommend keeping the original ticket (email, PDF, official app, or physical copy) as your authoritative record, and using Passpartoo as a convenient organizational layer on top of it.
• We are not responsible for denied entry, lost tickets, or any other consequence resulting from reliance on data stored in or displayed by the App, including data loss caused by uninstalling the App, device loss/damage, or App malfunction.

6. No Warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Passpartoo's developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of access to an event, or any other loss arising from your use of, or inability to use, the App — even if advised of the possibility of such damages.

Without prejudice to the foregoing, and to the maximum extent permitted by applicable law, our total aggregate liability to you arising out of or in connection with these Terms or your use of the App, whether in contract, tort (including negligence), or otherwise, shall not exceed one hundred euros (€100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by negligence, to the extent such exclusion is prohibited by the mandatory law of the jurisdiction governing these Terms.

8. Dispute Resolution

Before commencing any formal legal proceedings (including arbitration or litigation) against us in connection with these Terms or the App, you agree to first contact us at passpartoo.app@gmail.com with a written description of your complaint, and to give us a reasonable opportunity — at least thirty (30) days from that notice — to investigate and, where appropriate, resolve the matter directly with you before escalating further.

If a dispute is not resolved informally as described above, either party may choose to submit the dispute to binding arbitration under the rules of the Netherlands Arbitration Institute (NAI), as an alternative to litigation. Arbitration under this Section is available at either party's option; it does not replace or waive your right to instead bring proceedings before the competent courts referred to in Section 13 (Governing Law), to the extent such right cannot be waived under applicable consumer-protection law.

9. Intellectual Property

The App, including its design, logo, branding, and underlying code, is owned by Volodymyr Brunets, operating as an individual entrepreneur, and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding beyond what's necessary to use the App as intended.

Any tickets, images, or documents you store in the App remain your own property (or that of the original rights holder) — we claim no ownership over content you add to the App.

10. Third-Party Services

The App uses Sentry for crash/error reporting, as described in our Privacy Policy. Your use of the App is also subject to Apple's standard End User License Agreement (EULA) for apps distributed via the App Store, unless we provide a custom EULA.

11. Termination

You may stop using the App at any time by deleting it from your device. We may discontinue, suspend, or modify the App at any time, with or without notice, though we will make reasonable efforts to communicate material changes in advance where practical.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions, and any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
